Customs and trade is a highly specialized area involving arcane rules and administrative practices. Issues can arise when importers and Canada Border Services Agency disagree on how goods should be accounted for in terms of tariff classification, duty rate (including eligibility under arrangements like NAFTA), and valuation. Problems can also arise where there are anti-dumping or countervailing duties in effect. The potential risks for importers include imposition of additional duties and penalties by CBSA. Exporters should be aware of Canada’s export controls regime, which applies not only to goods but also to information.
